Minutes of Meeting

September 19, 2000

        A regular meeting of the Connecticut Law Revision Commission Electronic Communications Committee was held in Hearing Room 1B of the Legislative Office Building in Hartford on Tuesday, September 19, 2000 at 10:00 a.m. Members present were: Sharon Aresco; Wanda Dupuy; Marc Edrich; Elizabeth Gara; Gary Hawes; John Kreitler; Houston Putnam Lowry; Robert Mitchell; Jo Roberts; Steven Schwane. Also present were David Biklen and David Benoit for Norman Roos.

        Ms Roberts opened the meeting.

        The members discussed definitions (5), (8) and (13) in section 2 of the draft. These definitions will be redrafted as discussed.

        The members discussed section 3 of the draft and approved it as presently drafted.

        The members agreed to delete subsection (4) of section 6 of the draft and substitute a new section 19, recommended by the National Conference of Commissioners on Uniform State Laws, to indicate that the state act is intended to be in compliance with the federal Electronic Signatures in Global and National Commerce Act recently passed by Congress.

        The members discussed new section 8, which incorporates by reference the consumer disclosures (section 101(c)(1)) from the federal act. The members agreed to incorporate provisions (2) through (6) of section 101(c) of the federal act by reference as well.

        The members voted to approve the entire act and commentary, to be revised as discussed at this meeting.

        Ms Roberts will complete the final version of the act and will send it and an accompanying report of the committee to the Law Revision Commission to the members for their final review and comment. The draft and report will be submitted to the Law Revision Commission at the Commission’s October or November meeting.

        Both Ms Roberts and David Biklen, Executive Director of the Law Revision Commission, thanked the members for their dedicated and valuable service to the project.

        There being no further business, the meeting was adjourned.
