Minutes of Meeting

July 18, 2000

A regular meeting of the Connecticut Law Revision Commission Electronic Communications Committee was held in Hearing Room 1E of the Legislative Office Building in Hartford on Tuesday, July 18, 2000 at 10:00 a.m. Members present were: Sharon Aresco; Wanda Dupuy; Marc Edrich; Richard Hogan; John Kreitler; Dennis LaGanza; Houston Lowry; Robert Mitchell; Jo Roberts; Norman Roos; Steven Schwane; and Fillis Stober. Also present were David Biklen and Christopher Reinhart of the Office of Legislative Research.

Ms Roberts opened the meeting.

The members discussed a proposal by Houston Lowry to incorporate the provisions of the UNCITRAL Model Law addressing international electronic transactions into UETA. After some discussion the matter was tabled until the next meeting.

The members discussed redrafted section 3 of UETA. The committee agreed to review subsection (a)(3), which excludes recording statutes from coverage of the act, to determine which of the suggested statutes should be excluded and whether other statutes should be excluded as well.

The members approved the additional exclusions taken from Section 103(b) of the federal Electronic Signatures in Global and National Commerce Act recently passed by Congress, with some revision. The section will be redrafted as discussed.

The members discussed new section 8, which incorporates the consumer disclosures (section 101(c)) and additional exclusions (section 103(b)) from the federal act. After much discussion about the relationship between UETA and any future revisions to the federal act, the members agreed to incorporate the provisions of the federal act, as amended from time to time, by reference into UETA.

The members discussed sections 6, 9 and 17 of UETA. The sections will be redrafted as discussed.

The members discussed sections 10-16 and 21 of UETA. The sections were approved without revision.

The members agreed to delete sections 18-20 and 22 from the act.

There being no further business, the meeting was adjourned. The next meeting of the Electronic Communications Committee will be held on Tuesday, September 19, 2000 at 10:00 a.m. in a location to be determined.
