Although not specified in the amendment, if the provisions of the amendment are interpreted to mean the Comptroller is required to enforce and implement the standards and requirements of the amendment there may be an increased cost to the state.
In addition, the amendment removes the liability of participating providers if they follow the care guidelines developed by the Comptroller. However the amendment does not specify who would be liable for damages should a claim arise. The state could experience additional costs if the state is held responsible as the entity which developed the care guidelines for participating providers.
