AN ACT CONCERNING PROHIBITING THE TRANSFER OF ASSAULT WEAPONS OR MACHINE GUNS TO MINORS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. Subsection (a) of section 53-202b of the general statutes is repealed and the following is substituted in lieu thereof (Effective October 1, 2009):

(a) (1) Any person who, within this state, distributes, transports or imports into the state, keeps for sale, or offers or exposes for sale, or who gives any assault weapon, except as provided by sections 29-37j and 53-202a to 53-202k, inclusive, and subsection (h) of section 53a-46a, shall be guilty of a class C felony and shall be sentenced to a term of imprisonment of which two years may not be suspended or reduced.

(2) Any person who transfers, sells or gives any assault weapon to a person under eighteen years of age in violation of subdivision (1) of this subsection, including the temporary transfer of such weapon to such person for use in target shooting or on a firing or shooting range or for any other purpose, shall be sentenced to a term of imprisonment of six years, which shall not be suspended or reduced and shall be in addition and consecutive to the term of imprisonment imposed under subdivision (1) of this subsection.

Sec. 2. Subsection (c) of section 53-202 of the general statutes is repealed and the following is substituted in lieu thereof (Effective October 1, 2009):

(c) Any person who (1) possesses [or] a machine gun, (2) uses a machine gun for an offensive or aggressive purpose, or (3) notwithstanding the provisions of subdivision (3) of subsection (h) of this section, transfers, sells or gives a machine gun to a person under eighteen years of age, including the temporary transfer of such weapon to such person for use in target shooting or on a firing or shooting range or for any other purpose, shall be fined not more than one thousand dollars or imprisoned not less than five years nor more than ten years or be both fined and imprisoned.

This act shall take effect as follows and shall amend the following sections:

Statement of Purpose:

To prohibit the permanent or temporary transfer of an assault weapon or machine gun to a person under eighteen years of age.
