AN ACT CONCERNING AUTOMATIC EXTERNAL DEFIBRILLATORS

SUMMARY: This act provides immunity in a lawsuit for damages for acts arising out of a person's or entity's negligence in providing or maintaining an automatic external defibrillator (AED). Existing law already provides immunity for those rendering assistance.

The act specifies that immunity does not apply to gross, willful, or wanton negligence. Lastly, it makes technical changes.

BACKGROUND

Automatic External Defibrillators

An AED is a portable automatic device used to restore normal heart rhythm to people having heart attacks. It (1) contains internal decision-making electronics, microcomputers, or special software that allows it to interpret physiologic signals, make a medical diagnosis, and apply necessary therapy; (2) guides the user through the operations process; and (3) does not require the user to exercise any discretion or judgment.
