PUBLIC ACT NO. 97-155
AN ACT CONCERNING THE CONNECTICUT MARKETING
AUTHORITY.
Be it enacted by the Senate and House of
Representatives in General Assembly convened:
Section 1. Section 22-63 of the general
statutes is repealed and the following is
substituted in lieu thereof:
There shall continue to be a Marketing
Authority within the Department of Agriculture.
The authority shall continue to have and exercise
the powers and duties authorized for it by this
chapter. Such authority shall consist of [nine]
ELEVEN members. The authority shall be composed of
one public member from each congressional district
of the state, an at-large public member, the
Commissioner of Agriculture or his designee, and
the Commissioner of Economic and Community
Development or his designee. The Governor shall
appoint three members of the authority and the
president pro tempore of the Senate, the Senate
minority leader, the speaker of the House of
Representatives and the minority leader of the
House of Representatives shall each appoint one
member. IN ADDITION, THE GOVERNOR SHALL APPOINT
TWO MEMBERS OF THE AUTHORITY WHO SHALL BE TENANTS
OF THE HARTFORD MARKET FACILITY. Any vacancy in
the membership of said authority shall be filled
by appointment for the unexpired portion of the
term. The name of the authority shall be
"Connecticut Marketing Authority". The members of
the authority shall serve without compensation,
but their necessary expenses incurred in the
performance of their duties shall be paid by the
state. Any member absent from three consecutive
meetings shall be deemed to have resigned.
Sec. 2. Section 22-75 of the general statutes
is repealed and the following is substituted in
lieu thereof:
Any net income to the authority shall be used
to create a reserve fund [. Within six months
after the close of each fiscal year, any balance
in the reserve fund as of the close of such fiscal
year in excess of twenty-five thousand dollars, as
shown by cash balances, accounts receivable and
amounts due from other state funds less accounts
payable and a reasonable reserve] for payment of
repairs, capital improvements in such amount as
shall be approved by the Secretary of the Office
of Policy and Management, and outstanding bonds
and interest thereon due and payable in the
succeeding fiscal year. [, shall be transferred to
the General Fund until fifty per cent of the
original appropriation for the Connecticut
Regional Market at Hartford of two hundred fifty
thousand dollars is repaid, at which time such
transfers shall cease.] The reserve fund may be
used by the authority to carry out the purposes of
this chapter.
