The House of Representatives was called to order at 11: 41 o'clock a. m. , Speaker Christopher G. Donovan in the Chair.

Prayer was offered by Deputy Chaplain, Rabbi Craig Marantz of Glastonbury, Connecticut.

Let us pray. Holy One of Blessings, we assemble today to exercise leadership. Leadership is an honor - leadership is a privilege - leadership is a responsibility. "Sec. 502. (NEW) (Effective from passage) If any sentence imposed under subdivision (1) of section 53a-35a of the general statutes, as amended by this act, is reduced or invalidated on the basis of the amendments made to section 53a-35a of the general statutes pursuant to section 2 of this act, or if any placement or condition of confinement of an inmate is invalidated on the basis of the provisions of section 501 of Senate Amendment Schedule "A", the amendments to sections 53a-54b, 53a-35a, 53a-35b, subsection (a) of section 53a-45, subsection (a) of section 53a-46a, subsection (a) of section 53a-46b, subsection (c) of section 53a-54a, subdivision (2) of subsection (j) of section 10-145b, section 10-145i, subsection (a) of section 46b-127, subsection (a) of section 46b-133, subsection (c) of section 51-36, subsection (b) of section 51-199, sections 51-246 and 51-286c, subdivision (1) of subsection (a) of section 52-434, subsection (b) of section 53a-25, subsection (a) of section 53a-30, subsection (a) of section 53a-39a, subsection (a) of section 53a-40d, section 53a-46d, subsection (a) of section 53a-182b, subsection (a) of section 53a-217d, subsection (b) of section 54-2a, subsection (a) of section 54-46a, sections 54-82 and 54-82g, subsection (a) of section 54-82h(a), section 54-83, subsection (a) of section 54-91a, subsection (b) of section 54-102jj, subsection (b) of section 54-125a, subsection (d) of section 54-125d, section 54-131b, subsection (a) of section 54-131k and subsection (a) of section 54-193 of the general statutes, pursuant to sections 1 to 36, inclusive, of this act, and the provisions of section 501 of Senate Amendment Schedule "A" shall, on and after the date of the final decision regarding such reduction or invalidation and any appeal therefrom, be inoperative and have no effect, and said provisions of the general statutes, revision of 1958, revised to January 1, 2012, shall be effective on and after said date. "

The following is House Amendment Schedule "C" (LCO 3122):

Strike section 501 of Senate Amendment Schedule "A" in its entirety and substitute the following in lieu thereof:

"Sec. 501. (NEW) (Effective from passage) (a) The Commissioner of Correction shall place an inmate on special circumstances high security status and house the inmate in administrative segregation if (1) the inmate is convicted of the class A felony of murder with special circumstances committed on or after the effective date of this section under the provisions of section 53a-54b of the general statutes, as amended by this act, in effect on or after the effective date of this section, and sentenced to a term of life imprisonment without the possibility of release, or (2) the inmate is in the custody of the Commissioner of Correction for a capital felony committed prior to the effective date of this section under the provisions of section 53a-54b of the general statutes in effect prior to the effective date of this section for which a sentence of death is imposed in accordance with section 53a-46a of the general statutes, as amended by this act, and such inmate's sentence is (A) reduced to a sentence of life imprisonment without the possibility of release by a court of competent jurisdiction, or (B) commuted to a sentence of life imprisonment without the possibility of release.

(b) The commissioner shall place an inmate described in subsection (a) of this section in a housing unit for the maximum security population and shall (1) maintain the inmate on special circumstances high security status, (2) house the inmate separate from inmates who are not on special circumstances high security status, and (3) impose conditions of confinement on such inmate which shall include, but not be limited to, conditions that require (A) that the inmate's movements be escorted or monitored, (B) that the inmate be moved to a new cell at least every ninety days, (C) that the inmate's cell be searched at least twice each week, (D) that no contact be permitted during the inmate's social visits, (E) that the inmate be assigned to work assignments that are within the assigned housing unit, and (F) that the inmate be allowed no more than two hours of recreational activity per day. "

"Sec. 501. (NEW) (Effective from passage) The Commissioner of Correction shall prohibit an inmate from using correspondence privileges to place an advertisement or offer in electronic or print media which includes an explicit or implicit offer to exchange goods or services for which something of value is given to or received by any person, or to solicit any person to correspond with the inmate, if the inmate has been convicted of (1) the class A felony of murder with special circumstances committed on or after the effective date of this section under the provisions of section 53a-54b of the general statutes, as amended by this act, in effect on or after the effective date of this section, and is sentenced to a term of life imprisonment without the possibility of release, or (2) a capital felony committed prior to the effective date of this section under the provisions of section 53a-54b of the general statutes in effect prior to the effective date of this section for which a sentence of death is imposed in accordance with section 53a-46a of the general statutes, as amended by this act. "

The following is House Amendment Schedule "E" (LCO 3175):

After the last section, add the following and renumber sections and internal references accordingly:

"Sec. 501. (NEW) (Effective from passage) (a) Notwithstanding the provisions of this act, any person convicted of murder with special circumstances under subdivision (1) of section 53a-54b of the general statutes, as amended by this act, for the murder of an employee of the Department of Correction or a person providing services on behalf of said department when such employee or person is acting within the scope of such employee's or person's employment or duties in a correctional institution or facility and the actor is confined in such institution or facility, committed on or after the effective date of this section, shall be sentenced to a term of life imprisonment without the possibility of release unless a sentence of death is imposed in the manner prescribed in section 53a-46a of the general statutes, as amended by this act.

(b) The provisions of this act applicable to a person who commits a capital felony prior to the effective date of this section shall apply in like manner to a person convicted of murder as provided in subsection (a) of this section. "

This act shall take effect as follows and shall amend the following sections:

The following is House amendment Schedule "K" (LCO 3126):

"Sec. 501. (NEW) (Effective from passage) (a) Notwithstanding the provisions of this act, any person convicted of murder with special circumstances under subdivision (6) of section 53a-54b of the general statutes, as amended by this act, for the murder of a person in the course of the commission of sexual assault in the first degree, committed on or after the effective date of this section, shall be sentenced to a term of life imprisonment without the possibility of release unless a sentence of death is imposed in the manner prescribed in section 53a-46a of the general statutes, as amended by this act.

(b) The provisions of this act applicable to a person who commits a capital felony prior to the effective date of this section shall apply in like manner to a person convicted of murder as provided in subsection (a) of this section. "

The following is House Amendment Schedule "L" (LCO 3127):

After the last section, add the following and renumber sections and internal references accordingly:

"Sec. 501. Section 18-98e of the 2012 supplement to the general statutes is repealed and the following is substituted in lieu thereof (Effective from passage):

(a) Notwithstanding any provision of the general statutes, any person sentenced to a term of imprisonment for a crime committed on or after October 1, 1994, and committed to the custody of the Commissioner of Correction on or after said date, except a person sentenced for a violation of section 53a-54a, 53a-54b, 53a-54c, 53a-54d, 53a-55, 53a-55a, 53a-56, 53a-56a, 53a-56b, 53a-57, 53a-59, 53a-59a, 53a-60, 53a-60a, 53a-60b, 53a-60c, 53a-70, 53a-70a, [or] 53a-70b, 53a-72b, 53a-92, 53a-92a, 53a-94, 53a-94a, 53a-95, 53a-100aa, 53a-101, 53a-102, 53a-102a, 53a-103a, 53a-111, 53a-112, 53a-134, 53a-135, 53a-136, 53a-167c, 53a-179b, 53a-179c or 53a-181c, may be eligible to earn risk reduction credit toward a reduction of such person's sentence, in an amount not to exceed five days per month, at the discretion of the Commissioner of Correction for conduct as provided in subsection (b) of this section occurring on or after April 1, 2006.

(b) An inmate may earn risk reduction credit for adherence to the inmate's offender accountability plan, for participation in eligible programs and activities, and for good conduct and obedience to institutional rules as designated by the commissioner, provided (1) good conduct and obedience to institutional rules alone shall not entitle an inmate to such credit, [and] (2) the commissioner or the commissioner's designee may, in his or her discretion, cause the loss of all or any portion of such earned risk reduction credit for any act of misconduct or insubordination or refusal to conform to recommended programs or activities or institutional rules occurring at any time during the service of the sentence or for other good cause, and (3) the commissioner or the commissioner's designee shall cause the loss of all such earned risk reduction credits for any person who earned such credits prior to the effective date of this section while sentenced for a violation of section 53a-55, 53a-55a, 53a-56, 53a-56a, 53a-56b, 53a-57, 53a-59, 53a-59a, 53a-60, 53a-60a, 53a-60b, 53a-60c, 53a-70, 53a-70a, 53a-70b, 53a-72b, 53a-92, 53a-92a, 53a-94, 53a-94a, 53a-95, 53a-101, 53a-102, 53a-102a, 53a-103a, 53a-111, 53a-112, 53a-134, 53a-135, 53a-136, 53a-167c, 53a-179b, 53a-179c or 53a-181c. If an inmate has not earned sufficient risk reduction credit at the time the commissioner or the commissioner's designee orders the loss of all or a portion of earned credit, such loss shall be deducted from any credit earned by such inmate in the future.

(c) The award of risk reduction credit earned for conduct occurring prior to July 1, 2011, shall be phased in consistent with public safety, risk reduction, administrative purposes and sound correctional practice, at the discretion of the commissioner, but shall be completed not later than July 1, 2012.

(d) Any credit earned under this section may only be earned during the period of time that the inmate is sentenced to a term of imprisonment and committed to the custody of the commissioner and may not be transferred or applied to a subsequent term of imprisonment. In no event shall any credit earned under this section be applied by the commissioner so as to reduce a mandatory minimum term of imprisonment such inmate is required to serve by statute.

(e) The commissioner shall adopt policies and procedures to determine the amount of credit an inmate may earn toward a reduction in his or her sentence and to phase in the awarding of retroactive credit authorized by subsection (c) of this section. "

The following is House Amendment Schedule "M" (LCO 3172):

Strike everything after the enacting clause and substitute the following in lieu thereof:

"Section 1. (Effective from passage) (a) The following question shall be transmitted upon receipt by the Secretary of the State to the municipal clerk of each town at least thirty days before November 6, 2012, and on November 6, 2012, a special advisory referendum shall be held in each such town on that question. The referendum shall be held in conjunction with the state election to be held in each such town. The municipal clerk or assistant clerk in each town shall warn the electors in the town to meet on the date and at the hour prescribed for the referendum and at the usual place or places of holding state elections in the town, for the purpose of their approval or disapproval of the question: "Do you support the repeal of the death penalty in Connecticut?"

(b) The special advisory referendum shall be organized and conducted in the same manner as a state election and the vote shall be declared, certified, directed, deposited, returned and transmitted in the same manner as a state election. The hours for such referendum shall be from six o'clock a. m. to eight o'clock p. m.

(c) The municipal clerk of each town shall, within ten days after November 6, 2012, return to the Secretary of the State a statement of the vote on the special advisory referendum question. The vote shall be of no legal effect and no recanvass shall be required, except as may be required in the course of an investigation of election law violations. The provisions of chapter 152 of the general statutes relating to referenda shall apply to the special advisory referendum. "
