OLR Bill Analysis
AN ACT DIRECTING A PORTION OF THE MARIJUANA AND CONTROLLED SUBSTANCES TAX TO MUNICIPALITIES.
The law prohibits the purchase, acquisition, transportation, or importation of marijuana or controlled substances into the state and imposes a tax on violators. This bill entitles a municipality to 40% of the tax when it notifies the revenue services commissioner of a potential violation of the law following the municipality's lawful arrest of a dealer or lawful search of the dealer's real or personal property. The bill allows the chief of police of a municipality with a police department or the chief elected official of a town without a police department to provide the notice.
EFFECTIVE DATE: October 1, 2009

sSB 349, reported favorably by the Judiciary Committee, (1) decriminalizes the possession of up to one-half ounce of marijuana by an adult and (2) reduces to an infraction, with a $ 250 fine, the penalty for possession of up to on-half ounce of marijuana by these adults.
