AN ACT CONCERNING THE USE OF ELECTRONIC SURVEILLANCE EQUIPMENT IN THE PUBLIC AREAS OF RETAIL STORES AND OTHER COMMERCIAL ESTABLISHMENTS.

SUMMARY:

This bill requires retail stores and commercial establishments to post conspicuous signs when they operate electronic surveillance devices in public areas, except (1) areas designated for employees' health or comfort and (2) store dressing rooms. (By law stores are barred from operating surveillance devices in dressing rooms. ) Violators are subject to imprisonment for up to 30 days, a fine of up to $ 200, or both.

EFFECTIVE DATE: October 1, 2009

SIGNS

Signs must be posted in retail stores or commercial establishments that are open to the public at regular business hours. Signs must be at least 24” by 36”, use boldface block letters and read: ”THE PUBLIC AREAS OF THIS ESTABLISHMENT ARE MONITORED BY ELECTRONIC SURVEILLANCE DEVICES.

Although the bill specifies the size and placement of the signs, it authorizes the consumer protection commissioner to adopt regulations prescribing sign type size and placement.
