"Sec. 501. (NEW) (Effective July 1, 2004) (a) The Department of Transportation shall allocate annually any amount transferred to the Section 402 Highway Safety Grant Program, under the provisions of 23 USC 154, for hazard elimination activities eligible for funding under 23 USC 152. Two hundred thousand dollars of such amount shall be allocated by said department during the fiscal year ending June 30, 2005, for system hardware, software licenses and configuration and installation costs for a video incident responder system to disseminate video transmissions from the Interstate 95 video camera network to authorized law enforcement and emergency service personnel to better coordinate responses to highway incidents. "

"

Representative Amann of the 118th District moved for suspension of the rules for immediate consideration.

Senate Joint Resolution No. 33 was adopted by a standing moment of silence.
The following is the Resolution:
Resolved by this Assembly:
WHEREAS, Edward J. Opalacz, Sr. , a native of Middletown, died on April 1, 2004, at the age of 85, after a long and distinguished career in public service; and
WHEREAS, he was a member of the House of Representatives from 1949 to 1950, and was a State Senator from 1951 to 1956, where he served on the committees on Agriculture; Appropriations; Contingent Expenses; Insurance; Military and Veterans' Affairs; Public Buildings and Grounds; Public Welfare and Human Institutions; and Roads, Rivers and Bridges; and, during his last term, served as Senate Chairman of the Appropriations Committee; and
WHEREAS, he was born and raised in a farmhouse, attended Woodrow Wilson High School, and worked at Russell Manufacturing Company; and
WHEREAS, he joined the United States Army in 1942 and served in the Pacific, participating in the Saipan and Okinawa invasions, and was a member of the first unit of the American Occupation Force to land in Japan; and
WHEREAS, after his discharge from active service in 1946, he was an active member of the Army Reserves for many years, retiring at the rank of colonel; and
WHEREAS, patriotism was among his highest values and he was known for not missing a Memorial Day or Pulaski Day parade, always marching with the Catholic War Veterans and counting cadence; and
WHEREAS, he attended the New Haven College of Commerce, studying insurance and real estate, and in 1947 began his own insurance agency, the Opalacz Agency; and
WHEREAS, he also began his career in public service in 1947, serving as Housing Commissioner in the city of Middletown from 1947 to 1952; and
WHEREAS, he began his 36-year career as the city of Middletown's tax assessor in 1955, serving in that position through the terms of nine mayors, and seeing the city's grand list grow from $74 million to $1. 75 billion at the time of his retirement; and
WHEREAS, he was instrumental in securing Middletown as the location for the first regional library, in obtaining funding to build the lake and walking trails in Wadsworth Falls State Park in 1957, and in causing Route 66 to be designated as a state highway; and
WHEREAS, he was committed to and active in Catholic education, participating in the original building committee for Xavier and Mercy high schools, and serving as president of the Xavier Home and School Association and chairman of the Athletic Committee; and
WHEREAS, he was an active member of the American Legion, Catholic War Veterans Post 1166, VFW, B. P. O. Elks Lodge No. 771, Polish Falcons Nest No. 519, Knights of Columbus Forest City Council No. 3, Polish National Home, Kosciuszko Society, St. Casimir Society, and the YMCA, having established the swim team at Northern Middlesex YMCA; and
WHEREAS, he served as a director of Farmers & Mechanics Bank, corporator of Middlesex Hospital, and trustee of St. Mary's of Czestochowa Church and most recently served on St. Mary's Church 100th Jubilee Anniversary Committee; and
WHEREAS, among the awards he received were the Dr. Francis of Xavier Award in 1987 of which he was one of the first recipients; the Gold Legion of Honor in 1984, which is the highest award of the international Polish Falcons; the Distinguished Citizen of the Year Award in 1989 by the Middlesex County Chamber of Commerce; and the Good Scout Community Award; and
WHEREAS, he was widely regarded for working effectively with people holding divergent views, having never lost an election, and was cited for his success in working with both Democrats and Republicans in a thesis written by then state legislative aide, and now U. S. Senator, Joseph Lieberman; and
WHEREAS, he was esteemed for his commitment to the people of Middletown, described as a "fine gentleman and a great human being" and a "great citizen" of the city of Middletown, by State Senator Biagio "Billy" Ciotto; and
WHEREAS, despite the hours upon hours he spent in helping the people of the city of Middletown, he always had time for his family, being described by his family as "first and foremost a family man"; and
WHEREAS, he leaves his wife of 56 years, Jane Siemaszko, three sons, Clifford Opalacz and his wife, Patricia of Waterford, Dr. Edward Opalacz, Jr. , and his wife, Mary of Durham, and Dr. Stanislaus Opalacz and his wife, Dr. Kayoko of Middletown; his daughter, Teresa Opalacz and his favorite son-in-law, Ken Landy; a brother, Frank Opalacz of Middletown; three sisters, Mary Ostafin of Wethersfield, and Violet Krywinski and Eleanor Novicki, both of Middletown; ten grandchildren, Edward John Opalacz, III, Brian Opalacz, Genna Opalacz, Roman Opalacz, Aniella Opalacz, Arissa Opalacz, Stefan Opalacz, Tucker Landy, Jane "Sheena" Landy and Kendra Landy; and several nieces and nephews.
NOW, THEREFORE, BE IT RESOLVED that the Connecticut General Assembly does hereby express its sincere and heartfelt condolences on the death of Edward J. Opalacz, Sr. , which is a profound loss to the people of the city of Middletown and of the State of Connecticut; and
BE IT FURTHER RESOLVED that a copy of this resolution be presented to the family of Edward J. Opalacz, Sr. as an expression of the high esteem and affection in which he was held.

APPROPRIATIONS. Substitute for H. B. No. 5007 (RAISED) (File No. 579) AN ACT CONCERNING PERSONAL CARE ASSISTANCE AND THE HOME-CARE PROGRAM.

The following is House Amendment Schedule "A" (LCO 4049):
Strike everything after the enacting clause and substitute the following in lieu thereof:
"Section 1. (NEW) (Effective July 1, 2004) (a) Until June 30, 2006, the Commissioner of Social Services shall, within available appropriations, establish and operate a state-funded pilot program to allow no more than one hundred persons who are sixty-five years of age or older and meet the eligibility requirements of the Connecticut home-care program for the elderly established under section 17b-342 of the general statutes to receive personal care assistance as an alternative covered service to home health services in order to avoid institutionalization, provided the average annual cost to the state for such personal care assistance for each recipient in the pilot program does not exceed the average annual cost to the state for a recipient of home health services provided under the program. Personal care assistance under the program may be provided by nonspousal family members of the recipient of services under the program.
(b) In conducting the pilot, the commissioner or the commissioner's agent (1) may require as a condition of participation that participants in the pilot program disclose if a personal care assistant is a nonspousal family member, (2) shall monitor the participants to ensure quality of services by the personal care assistants, and (3) shall ensure the cost-effectiveness of the program.
(c) The commissioner shall establish the maximum allowable rate to be paid for such services under the pilot program and may set a separate lower rate for nonspousal family members providing services as personal care assistants in the pilot program if deemed necessary by the commissioner to ensure cost effectiveness of the pilot program and to conduct the pilot program within available appropriations.
(d) Not later than January 1, 2006, the Commissioner of Social Services shall submit a report on the pilot program to the joint standing committees of the General Assembly having cognizance of matters relating to appropriations and human services and to the select committee of the General Assembly having cognizance of matters relating to aging. The report shall be submitted in accordance with section 11-4a of the general statutes.
Sec. 2. (NEW) (Effective from passage) The Commissioner of Social Services, pursuant to section 17b-342 of the general statutes, shall apply to the Centers for Medicaid and Medicare Services for a waiver to include in the Medicaid funded home-care program the pilot program established in section 1 of this act. In no event shall the number of pilot program participants exceed one hundred persons. "

The following is House Amendment Schedule "A" (LCO 3895):
Strike everything after the enacting clause and substitute the following in lieu thereof:
"Section 1. (NEW) (Effective October 1, 2004) As used in sections 1 to 9, inclusive, of this act, unless the context otherwise requires:
(1) "Debilitating medical condition" means (A) cancer, glaucoma, positive status for human immunodeficiency virus or acquired immune deficiency syndrome, or the treatment of any such conditions, including, but not limited to, chemotherapy, (B) a chronic or debilitating disease or medical condition, or the treatment thereof, that produces one or more of the following: (i) Cachexia or wasting syndrome; (ii) severe pain; (iii) severe nausea; (iv) seizures; or (v) severe and persistent muscle spasms, or (C) any other medical condition approved by the Department of Public Health, pursuant to regulations that the Commissioner of Public Health may adopt, in accordance with chapter 54 of the general statutes, in response to a request from a physician or potentially qualifying patient;
(2) "Marijuana" has the same meaning as provided in section 21a-240 of the general statutes, as amended;
(3) "Medical use" means the acquisition and distribution, possession, cultivation, use or transportation of marijuana or paraphernalia relating to marijuana to alleviate the symptoms or effects of a qualifying patient's symptoms, but does not include any such use of marijuana by any person other than the qualifying patient. For the purposes of this subdivision, "acquisition and distribution" means the transfer of marijuana and paraphernalia relating to marijuana from the primary caregiver to the qualifying patient;
(4) "Physician" means a person who is licensed under the provisions of chapter 370 of the general statutes, but does not include a physician assistant, as defined in section 20-12a of the general statutes;
(5) "Primary caregiver" means a person, other than the qualifying patient and the qualifying patient's physician, who is eighteen years of age or older and has agreed to undertake responsibility for managing the well-being of the qualifying patient with respect to the medical use of marijuana, provided, in the case of a qualifying patient lacking legal capacity, such person shall be a parent, guardian or person having legal custody of such qualifying patient;
(6) "Qualifying patient" means a person who is eighteen years of age or older and has been diagnosed by a physician as having a debilitating medical condition;
(7) "Usable marijuana" means the dried leaves and flowers of the marijuana plant, and any mixtures or preparations thereof, that are appropriate for the medical use of marijuana, but does not include the seeds, stalks and roots of the plant; and
(8) "Written certification" means a statement signed by the qualifying patient's physician stating that, in the physician's professional opinion, the qualifying patient has a debilitating medical condition and the potential benefits of the medical use of marijuana would likely outweigh the health risks of such use to the qualifying patient.
Sec. 2. (NEW) (Effective October 1, 2004) (a) A qualifying patient shall not be subject to arrest or prosecution, penalized in any manner, including, but not limited to, being subject to any civil penalty, or denied any right or privilege, including, but not limited to, being subject to any disciplinary action by a professional licensing board, for the medical use of marijuana if:
(1) The qualifying patient has been diagnosed by a physician as having a debilitating medical condition;
(2) The qualifying patient's physician has issued a written certification to the qualifying patient for the medical use of marijuana after the physician has prescribed, or determined it is not in the best interest of the patient to prescribe, prescription drugs to address the symptoms for which the certification is being issued;
(3) The amount of marijuana jointly possessed by the qualifying patient and the primary caregiver for medical use does not exceed five marijuana plants and one ounce of usable marijuana; and
(4) The cultivation of such marijuana occurs in a secure indoor facility.
(b) Subsection (a) of this section does not apply to:
(1) Any medical use of marijuana that endangers the health or well-being of another person; and
(2) The medical use of marijuana (A) in a motor bus or a school bus, as defined respectively in section 14-1 of the general statutes, as amended, or in any moving vehicle, (B) in the workplace, (C) on any school grounds, (D) at any public park, public beach, public recreation center or youth center or any other place open to the public, or (E) in the presence of a person under the age of eighteen. For the purposes of this subdivision, "presence" means within the direct line of sight of the medical use of marijuana or exposure to second-hand marijuana smoke, or both.
(c) A qualifying patient shall have not more than one primary caregiver at any time. A primary caregiver may not be responsible for the care of more than one qualifying patient at any time. A primary caregiver who is registered in accordance with subsection (a) of section 3 of this act shall not be subject to arrest or prosecution, penalized in any manner, including, but not limited to, being subject to any civil penalty, or denied any right or privilege, including, but not limited to, being subject to any disciplinary action by a professional licensing board, for the acquisition, distribution, possession, cultivation or transportation of marijuana or paraphernalia related to marijuana on behalf of a qualifying patient, provided the amount of any marijuana so acquired, distributed, possessed, cultivated or transported, together with the amount of marijuana jointly possessed by the qualifying patient and the primary caregiver, shall not exceed five marijuana plants and one ounce of usable marijuana. For the purposes of this subsection, "distribution" or "distributed" means the transfer of marijuana and paraphernalia related to marijuana from the primary caregiver to the qualifying patient.
(d) Any written certification for the medical use of marijuana issued by a physician under this section shall be valid for a period not to exceed one year from the date such written certification is signed by the physician.
Sec. 3. (NEW) (Effective October 1, 2004) (a) Each qualifying patient who is issued a written certification for the medical use of marijuana, and the primary caregiver of such qualifying patient, shall register with the Department of Agriculture and Consumer Protection. Such registration shall be effective until the expiration of the written certification issued by the physician. The qualifying patient and the primary caregiver shall provide sufficient identifying information, as determined by the department, to establish the personal identity of the qualifying patient and the primary caregiver. The qualifying patient or the primary caregiver shall report any change in such information to the department not later than five business days after such change. The department shall issue a registration certificate to the qualifying patient and to the primary caregiver and may charge a reasonable fee, not to exceed twenty-five dollars, for a registration under this subsection.
(b) Upon the request of a law enforcement agency, the Department of Agriculture and Consumer Protection shall verify whether a qualifying patient or a primary caregiver has registered with the department in accordance with subsection (a) of this section and may provide reasonable access to registry information obtained under this section for law enforcement purposes. Except as provided in this subsection, information obtained under this section shall be confidential and shall not be subject to disclosure under the Freedom of Information Act, as defined in section 1-200 of the general statutes.
Sec. 4. (NEW) (Effective October 1, 2004) (a) The Commissioner of Agriculture and Consumer Protection may adopt regulations, in accordance with chapter 54 of the general statutes, to establish (1) a required form for written certifications for the medical use of marijuana issued by physicians under section 2 of this act, and (2) requirements for registrations under section 3 of this act.
(b) The Commissioner of Agriculture and Consumer Protection shall collect a user fee from each qualifying patient to whom a written certification for the medical use of marijuana is issued under section 2 of this act for the purpose of offsetting the direct and indirect costs of administering the provisions of sections 1 to 9, inclusive, of this act. Such user fee shall be in addition to any registration fee charged under subsection (a) of section 3 of this act and shall be established by regulation adopted by the commissioner in accordance with chapter 54 of the general statutes. All user fees collected by the commissioner pursuant to this subsection shall be paid to the State Treasurer and credited to the account established pursuant to section 10 of this act.
Sec. 5. (NEW) (Effective October 1, 2004) Nothing in sections 1 to 9, inclusive, of this act shall be construed to require health insurance coverage for the medical use of marijuana.
Sec. 6. (NEW) (Effective October 1, 2004) (a) A qualifying patient or a primary caregiver may assert the medical use of marijuana as an affirmative defense to any prosecution involving marijuana, or paraphernalia relating to marijuana, under chapter 420b of the general statutes, provided such qualifying patient or such primary caregiver has strictly complied with the requirements of sections 1 to 9, inclusive, of this act.
(b) No person shall be subject to arrest or prosecution solely for being in the presence or vicinity of the medical use of marijuana as permitted under sections 1 to 9, inclusive, of this act.
Sec. 7. (NEW) (Effective October 1, 2004) A physician shall not be subject to arrest or prosecution, penalized in any manner, including, but not limited to, being subject to any civil penalty, or denied any right or privilege, including, but not limited to, being subject to any disciplinary action by the Connecticut Medical Examining Board or other professional licensing board, for providing a written certification for the medical use of marijuana if:
(1) The physician has diagnosed the qualifying patient as having a debilitating medical condition;
(2) The physician has explained the potential risks and benefits of the medical use of marijuana to the qualifying patient and, if the qualifying patient lacks legal capacity, to a parent, guardian or person having legal custody of the qualifying patient; and
(3) The written certification issued by the physician is based upon the physician's professional opinion after having completed a full assessment of the qualifying patient's medical history and current medical condition made in the course of a bona fide physician-patient relationship.
Sec. 8. (NEW) (Effective October 1, 2004) Any marijuana, paraphernalia relating to marijuana, or other property seized by law enforcement officials from a qualifying patient or a primary caregiver in connection with a claimed medical use of marijuana under sections 1 to 9, inclusive, of this act shall be returned to the qualifying patient or the primary caregiver immediately upon the determination by a court that the qualifying patient or the primary caregiver is entitled to the medical use of marijuana under sections 1 to 9, inclusive, of this act, as evidenced by a decision not to prosecute, a dismissal of charges or an acquittal. Law enforcement officials seizing live marijuana plants as evidence shall not be responsible for the care and maintenance of such plants. This section does not apply to any qualifying patient or primary caregiver who fails to comply with the requirements for the medical use of marijuana under sections 1 to 9, inclusive, of this act.
Sec. 9. (NEW) (Effective October 1, 2004) (a) Any person who makes a fraudulent representation to a law enforcement official of any fact or circumstance relating to the medical use of marijuana in order to avoid arrest or prosecution under chapter 420b of the general statutes shall be guilty of a class C misdemeanor.
(b) Any person who makes a fraudulent representation to a law enforcement official of any fact or circumstance relating to the issuance of a written certification for the medical use of marijuana by a physician to which section 7 of this act does not apply shall be guilty of a class A misdemeanor.
Sec. 10. (NEW) (Effective July 1, 2004) There is established a medical marijuana administration account which shall be a separate, nonlapsing account within the General Fund. The account shall contain the fees collected pursuant to subsection (b) of section 4 of this act, and any other moneys required by law to be deposited in the account, and shall be held in trust separate and apart from all other moneys, funds and accounts. Any balance remaining in the account at the end of any fiscal year shall be carried forward in the account for the fiscal year next succeeding. Investment earnings credited to the account shall become part of the account. Amounts in the account shall be expended only pursuant to appropriations by the General Assembly for the purpose of providing funds for administering the provisions of sections 1 to 9, inclusive, of this act.
Sec. 11. Subsection (a) of section 21a-246 of the general statutes, as amended by section 146 of public act 03-6 of the June 30 special session, is repealed and the following is substituted in lieu thereof (Effective October 1, 2004):
(a) No person within this state shall manufacture, wholesale, repackage, supply, compound, mix, cultivate or grow, or by other process produce or prepare, controlled substances without first obtaining a license to do so from the Commissioner of Agriculture and Consumer Protection and no person within this state shall operate a laboratory for the purpose of research or analysis using controlled substances without first obtaining a license to do so from the Commissioner of Agriculture and Consumer Protection, except that such activities by pharmacists or pharmacies in the filling and dispensing of prescriptions, or activities incident thereto, or the dispensing or administering of controlled substances by dentists, podiatrists, physicians [,] or veterinarians, or other persons acting under their supervision, in the treatment of patients shall not be subject to the provisions of this section, and provided laboratories for instruction in dentistry, medicine, nursing, pharmacy, pharmacology and pharmacognosy in institutions duly licensed for such purposes in this state shall not be subject to the provisions of this section except with respect to narcotic drugs and schedule I and II controlled substances. Upon application of any physician licensed pursuant to chapter 370, the Commissioner of Agriculture and Consumer Protection shall without unnecessary delay, license such physician to possess and supply marijuana for [the treatment of glaucoma or the side effects of chemotherapy] medical use pursuant to sections 1 to 9, inclusive, of this act. No person [without] outside this state shall sell or supply controlled substances within [the] this state without first obtaining a license to do so from the Commissioner of Agriculture and Consumer Protection, provided no such license shall be required of a manufacturer whose principal place of business is located outside [the] this state and who is registered with the federal Drug Enforcement [Agency] Administration or other federal agency, and who files a copy of such registration with the appropriate licensing authority under this chapter.
Sec. 12. Section 21a-253 of the general statutes, as amended by section 146 of public act 03-6 of the June 30 special session, is repealed and the following is substituted in lieu thereof (Effective October 1, 2004):
Any [person] qualifying patient or primary caregiver, as defined respectively in section 1 of this act, may possess or have under [his] such qualifying patient's or primary caregiver's control a quantity of marijuana less than or equal to that quantity supplied [to him] pursuant to a prescription made in accordance with the provisions of section 21a-249, as amended, by a physician licensed under the provisions of chapter 370 and further authorized by subsection (a) of section 21a-246, as amended by this act, by the Commissioner of Agriculture and Consumer Protection to possess and supply marijuana for [the treatment of glaucoma or the side effects of chemotherapy] medical use pursuant to sections 1 to 9, inclusive, of this act. The provisions of this section do not apply to the possession or control of marijuana in a quantity that exceeds the amount permitted for medical use pursuant to sections 1 to 9, inclusive, of this act. "

LABOR AND PUBLIC EMPLOYEES. H. B. No. 5405 (RAISED) (File No. 97) AN ACT IMPLEMENTING THE RECOMMENDATIONS OF THE LEGISLATIVE PROGRAM REVIEW AND INVESTIGATIONS COMMITTEE CONCERNING CORRECTION OFFICER STAFFING.

The following is House Amendment Schedule "A" (LCO 3846):
After the last section, add the following and renumber sections and internal references accordingly:
"Sec. 501. (NEW) (Effective from passage) (a) There is established a Commission on Government Accountability, Creativity and Efficiency that shall consist of the following twenty-nine members: (1) The chairpersons and ranking members of the Legislative Program Review and Investigations Committee and the joint standing committee on Appropriations; (2) three appointed by the speaker of the House of Representatives; (3) three appointed by the president pro tempore of the Senate; (4) three appointed by the majority leader of the House of Representatives; (5) three appointed by the majority leader of the Senate; (6) three appointed by the minority leader of the House of Representatives; (7) three appointed by the minority leader of the Senate; and (8) three appointed by the Governor. Any member of the commission appointed pursuant to subdivisions (2) to (7), inclusive, of this subsection may be a member of the General Assembly. All appointments to the commission shall be made on or before June 11, 2004. The members of the commission shall elect a chairperson.
(b) The commission shall review the report of the Task Force on Accountability, Creativity and Efficiency, and determine which areas recommended for further study within such report need to be reviewed and conduct such reviews.
(c) The commission shall begin its review not later than June 11, 2004, and, on or before January 5, 2005, shall submit a report on its findings and recommendations to the Governor and the joint standing committees of the General Assembly having cognizance of matters relating to such findings and recommendations, in accordance with the provisions of section 11-4a of the general statutes. The task force shall terminate on the date that it submits such report or January 5, 2005, whichever is earlier. "

[The object for which this corporation is created is to establish and maintain an asylum, infirmary, hospital, and home for the aged, imbecile, crippled, and indigent members of the Independent Order of Odd Fellows holding membership therein, and their wives, widows, and orphan children, and to raise an endowment or fund by contributions, voluntary tax on the members of the order, donations, devises, and bequests, the income, rents, and profits of which shall be applied to the support and maintenance of said home. ] This corporation is organized and shall be operated exclusively for charitable and educational purposes within the meaning of Section 501(c)(3) of the Internal Revenue Code of 1986, as amended, or any corresponding provision of any internal revenue law, to meet the needs of elderly, disabled and/or infirm persons for housing, health care and financial security and/or to provide day care services to children and/or adults, and in furtherance of the foregoing purposes and subject to the limitations of the Certificate of Incorporation of this corporation, to engage in any lawful act or activity for which corporations may be formed under the Connecticut Revised Nonstock Corporation Act, chapter 602 of the Connecticut General Statutes, as revised or replaced from time to time. "

"Sec. 501. The preamble to the resolution incorporating Bacon Academy in 1803 contained in Volumes I and II, Title I, Academies, of the Resolves and Private Laws of the State of Connecticut from the year 1789 to the year 1836 is amended to read as follows (Effective from passage):
Upon petition of Roger Bulkley and others, [shewing] showing that Pierpont Bacon, by his last Will and testatment, bequeathed the principal part of his estate to the first Society in Colchester, for the support of Schools therein.
Resolved by this Assembly, That [all persons by law capable of voting in school society meetings and living within the present limits of the first school society in Colchester, be and they are] there is hereby constituted, ordained and declared to be, from time to time, forever hereafter, one body corporate and politic in fact and in name, by the name of "The Trustees and Proprietors of Bacon Academy; " and by that name [they and their successors] said corporation shall and may have forever hereafter perpetual succession, and [are] it is hereby made capable in law to have, purchase, receive and hold to [them] it and [their] its successors, lands, tenements, hereditaments, rents, moneys, goods, chattels and effects of what kind or quality soever, [to any amount not exceeding one hundred thousand dollars in the whole,] including [their] its present fund, and the same to sell, grant, alien, dispose of, or manage in any manner consistent with the true intent and meaning of the donors or grantors thereof --- to sue and be sued, plead and be impleaded, defend and be defended in all or any court --- to have a common seal, and the same to break and renew at pleasure --- to make and execute such by-laws and regulations as [they] its trustees shall deem expedient for the governing and well ordering the concerns of said corporation, and not contrary to laws of this State [; and to nominate trustees, and to remove them from office and to choose such other officers as they may deem necessary; and the first meeting of said corporation shall be holden at the Meeting house in said society at such time as the said Roger Bulkley and Daniel Watrous shall, by warrant under their hands appoint, and notice thereof shall be given in the same manner as the meetings of said school society are now usually warned; and a meeting of said corporation shall be holden on the last Monday in April annually, and all future meetings may be warned in such manner as said corporation shall direct] --- and to otherwise conduct those activities that may be conducted by a corporation organized pursuant to the Connecticut Revised Nonstock Corporation Act, or any successor thereto, that is exempt from federal income taxation as an organization described in section 501(c)(3) of the Internal Revenue Code of 1986, as amended, or any successor thereto. And be it further resolved, that said corporation shall proceed and be regulated by the principles contained in the following articles, viz: ---
Sec. 502. Article 1 of the resolution incorporating Bacon Academy in 1803 contained in Volumes I and II, Title I, Academies, of the Resolves and Private Laws of the State of Connecticut from the year 1789 to the year 1836 is amended to read as follows (Effective from passage):
1. [There shall be established for ever hereafter in the first society of Colchester, a school by the name of Bacon Academy, for the instruction of youth in reading and writing English, in arithmetic, mathematics, the languages, and other branches of learning, and shall include a common school, and a school of a higher order to be opened and kept in the building erected for that purpose, near the Meeting house, unless other buildings shall be erected for the accommodation of said school. The common school shall have preference for support from the funds of said corporation, and the school of a higher order shall be supported by the surplus proceeds of said funds, and by such other interest and incomes as may in any way accrue to said Academy, without diminishing the principal of said funds] The Trustees and Proprietors of Bacon Academy shall be operated exclusively for charitable purposes for the benefit of the citizens of the Town of Colchester, Connecticut, including the promotion of education and the support of the Bacon Academy, lessening the burdens of government and the preservation of historic buildings.
Sec. 503. Article 2 of the resolution incorporating Bacon Academy in 1803 contained in Volumes I and II, Title I, Academies, of the Resolves and Private Laws of the State of Connecticut from the year 1789 to the year 1836 is amended to read as follows (Effective from passage):
2. The whole management and superintendence of [said] The Trustees and Proprietors of Bacon Academy [, at all times from and after the first Tuesday in July next,] shall be vested in a self-perpetuating Board of [twelve] not less than six nor more than eighteen Trustees, [seven of whom, and no more, shall be members of said corporation, and resident in said society, at the time of their appointment to said trust, and shall be styled the Trustees of Bacon Academy,] and by virtue of their office they and their successors shall be fully seized and possessed in right of and in trust for said corporation of all the real and personal estate, interest and revenues of said corporation, to use and improve the same for the greatest benefit of [said Academy] the exempt purposes of said corporation and for no other purpose.
Sec. 504. Article 5 of the resolution incorporating Bacon Academy in 1803 contained in Volumes I and II, Title I, Academies, of the Resolves and Private Laws of the State of Connecticut from the year 1789 to the year 1836 is amended to read as follows (Effective from passage):
[5] 3. The [trustees] Board of Trustees shall have power to [hold and use the seal of said corporation, and in the name of said corporation may at their discretion, institute and defend in all suits or actions involving the interest of said corporation, and may submit any matter of dispute or controversy concerning their rights or interest to the award of arbitrators, and shall have the general power of securing, receiving and paying out the income or revenues of said corporation, and of conducting and managing the whole affairs and business of said Academy, not otherwise in this resolve provided for, in such manner as they shall judge most conducive to its prosperity and the design of their trust; and any three of said trustees resident in said society and selected and appointed for that purpose by said corporation, at their annual meeting or at any other legal meeting warned for that purpose, shall be the committee of the inhabitants of said society to loan the moneys belonging to said fund as directed in said last will and testament. And the said trustees and said committee shall annually report to said corporation the expenditures of the preceding year and of the state of their funds, and shall receive no emolument for their services except for actual expenses and time spent in taking care of said estate] manage and conduct the property and affairs of The Trustees and Proprietors of Bacon Academy pursuant to the bylaws of said corporation and shall be entitled to the full benefit of the limitations on personal liability and the right to obligatory indemnification permitted under section 33-1026 of the Connecticut General Statutes, or any successor thereto.
Sec. 505. (Effective from passage) Articles 3, 4, 6 and 7 of the resolution incorporating Bacon Academy in 1803 contained in Volumes I and II, Title I, Academies, of the Resolves and Private Laws of the State of Connecticut from the year 1789 to the year 1836 are repealed.
Sec. 506. (Effective from passage) The May 1827 alteration to the resolution incorporating Bacon Academy in 1803 contained in Volumes I and II, Title I, Academies, of the Resolves and Private Laws of the State of Connecticut from the year 1789 to the year 1836 is repealed.
Sec. 507. (Effective from passage) The resolution changing the time of holding the annual meeting of the corporation of Bacon Academy contained in Volume IV of the Resolves and Private Laws of the State of Connecticut from the year 1836 to the year 1857 is repealed.
Sec. 508. (Effective from passage) Number 298 of the Special Acts and Resolutions of 1893 is repealed. "

After the last section, add the following and renumber sections and internal references accordingly:
"Sec. 501. Subdivision (7) of section 12-81 of the general statutes, as amended by section 1 of public act 03-270, is repealed and the following is substituted in lieu thereof (Effective October 1, 2002, and applicable to assessment years commencing on or after October 1, 2002):
(7) Subject to the provisions of sections 12-87 and 12-88, the real property of, or held in trust for, a corporation organized exclusively for scientific, educational, literary, historical or charitable purposes or for two or more such purposes and used exclusively for carrying out one or more of such purposes and the personal property of, or held in trust for, any such corporation, provided (A) any officer, member or employee thereof does not receive or at any future time shall not receive any pecuniary profit from the operations thereof, except reasonable compensation for services in effecting one or more of such purposes or as proper beneficiary of its strictly charitable purposes, and (B) in 1965, and quadrennially thereafter, a statement shall be filed on or before the first day of November with the assessor or board of assessors of any town, consolidated town and city or consolidated town and borough, in which any of its property claimed to be exempt is situated. Such statement shall be filed on a form provided by such assessor or board of assessors. On and after July 1, 1967, housing subsidized, in whole or in part, by federal, state or local government and housing for persons or families of low and moderate income shall not constitute a charitable purpose under this section. As used in this subdivision, "housing" shall not include real property used for temporary housing belonging to, or held in trust for, any corporation organized exclusively for charitable purposes and exempt from taxation for federal income tax purposes, the primary use of which property is one or more of the following: (i) An orphanage; (ii) [A] a drug or alcohol treatment or rehabilitation facility; (iii) [Housing] housing for homeless, retarded or mentally or physically handicapped individuals, or for battered or abused women and children; (iv) [Housing] housing for ex-offenders or for individuals participating in a program sponsored by the state Department of Correction or judicial branch; and (v) [Short-term] short-term housing operated by a charitable organization where the average length of stay is less than six months. The operation of such housing, including the receipt of any rental payments, by such charitable organization shall be deemed to be an exclusively charitable purpose. "

Strike section 508 and insert the following in lieu thereof:
"Sec. 508. (Effective from passage) Notwithstanding the provisions of section 10-286 of the general statutes, as amended, or any regulation adopted by the State Board of Education setting square footage specifications for purposes of calculating eligible costs for a school building project grant, such square footage specifications shall not apply to the extension and alteration project (Project Number 135-0204-P/EA) Scofieldtown Middle Magnet School in Stamford. "
Sec. 509. (Effective from passage) Notwithstanding the provisions of section 10-283 of the general statutes, as amended, or any regulation adopted pursuant to said section 10-283, requiring that the funding authorization for the local share of the project costs be secured prior to application and that no school building project shall be added to the list in subdivision (1) of section 1 of this act, the project for a new interdistrict magnet University High School for Science and Engineering (Project Number 064-0287 MAG/N) at the University of Hartford is included in subdivision (1) of section 1 of this act and shall be eligible to be subsequently considered for a grant commitment from the state, provided the city of Hartford files an application for a school building project prior to June 30, 2004, meets all other provisions of chapter 173 of the general statutes or any regulation adopted by the State Board of Education.
Sec. 510. (Effective from passage) Notwithstanding any provision of chapter 173 of the general statutes or any regulation adopted by the State Board of Education in accordance with said chapter 173, the costs, up to one million seven hundred thousand dollars, associated with remediation of soil at Veterans' Field in New London for the purpose of locating temporary classrooms on such field as part of the construction project for the New Jennings Elementary School (Project Number 095-0079 N) shall be included as reimbursable costs of such project, provided the town of New London transfers control of such field to the local board of education.
Sec. 511. (Effective from passage) Notwithstanding the provisions of subdivision (1) of subsection (a) of section 10-286 of the general statutes, as amended, or any regulation adopted by the State Board of Education concerning projected enrollment for a school building project, the town of New Haven may increase the projected enrollment of the alteration project (Project Number 093-0319 A/RR) at Fair Haven Middle School to 930, the New Fair Haven K-8 School (Project Number 093-0317 N) to 690, and the New Jackie Robinson Replacement School (Project Number 093-0329 N) to 700. "

The following is House Amendment Schedule "A" (LCO 3815):
Strike everything after the enacting clause and substitute the following in lieu thereof:
"Section 1. (NEW) (Effective October 1, 2004) (a) As used in this section: (1) "Audiovisual recording function" means the capability of a device to record or transmit a motion picture by means of any technology, and (2) "motion picture theater" means a movie theater or screening room that, at the time of the offense, is being used for the exhibition of a motion picture.
(b) Any person who knowingly operates an audiovisual recording function of a device in a motion picture theater while a motion picture is being exhibited without the consent of the owner or lessee of such theater and with the intent to record such motion picture shall be guilty of a class B misdemeanor.
(c) Whenever the owner or lessee of a motion picture theater where a motion picture is being exhibited, or an employee or authorized agent of such owner or lessee, has reasonable grounds to believe that a person is operating or attempting to operate an audiovisual recording function of a device in such theater in violation of subsection (b) of this section, such owner, lessee, employee or agent may question such person as to such person's name and address and may detain such person for a time sufficient to summon a police officer to the premises. No other information shall be required of such person until a police officer has taken such person into custody. For the purposes of this subsection, "reasonable grounds" means knowledge that a person has operated or attempted to operate an audiovisual recording function of a device in such theater.
(d) In any civil action by a person detained under the provisions of subsection (c) of this section against the person so detaining him or her, or the principal or employer of such person, arising out of such questioning or detention by any such owner, lessee, employee or agent, evidence that the defendant had reasonable grounds to believe that the plaintiff was, at the time in question, operating or attempting to operate an audiovisual recording function of a device in a motion picture theater while a motion picture was being exhibited without the consent of the owner or lessee of such facility shall create a rebuttable presumption that the plaintiff was so operating or attempting to operate such audiovisual recording function.
(e) The provisions of this section shall not apply to the operation of an audiovisual recording function of a device by any authorized employee or agent of a local, state or federal law enforcement agency while such employee or agent is engaged in authorized investigative, protective, law enforcement or intelligence gathering activities.
(f) Nothing in this section shall preclude prosecution of a person under any other provision of the general statutes. "

JUDICIARY. H. B. No. 5606 (RAISED) (File No. 493) AN ACT CONCERNING THE RECOVERY OF DAMAGES FOR THE UNLAWFUL KILLING OR INJURING OF A COMPANION ANIMAL.

The following is House Amendment Schedule "A" (LCO 4309):
Strike everything after the enacting clause and substitute the following in lieu thereof:
"Section 1. (NEW) (Effective October 1, 2004) (a) For the purposes of this section, "companion animal" means a domesticated dog or cat that is normally kept in or near the household of its owner or keeper and is dependent on a person for food, shelter and veterinary care, but does not include a dog or cat kept for farming or biomedical research practices.
(b) Any person who intentionally kills or injures a companion animal, except in defense of such person or another person or as otherwise authorized by law, shall be liable to the owner of such companion animal for economic damages sustained by such owner including, but not limited to, expenses of veterinary care, the fair monetary value of the companion animal and burial expenses for the companion animal.
(c) In addition to any economic damages awarded pursuant to subsection (b) of this section, and except as provided in subsection (d) of this section, the court may award punitive damages in an amount not to exceed the jurisdictional monetary limit established by subsection (d) of section 51-15 of the general statutes, together with a reasonable attorney's fee.
(d) The court shall not assess punitive damages and a reasonable attorney's fee pursuant to subsection (c) of this section against: (1) A veterinarian licensed pursuant to chapter 384 of the general statutes while following accepted standards of practice of the profession, (2) the state or any political subdivision of the state or any employee, officer or agent thereof while acting within the scope of such employee's, officer's or agent's employment or official duties, or (3) an employee of or volunteer for a nonprofit organization or nonprofit corporation organized and operated exclusively for the prevention of cruelty to animals or the protection of stray, abandoned or mistreated animals while acting within the scope of such employee's or volunteer's employment or duties.
Sec. 2. Section 22-351 of the general statutes is repealed and the following is substituted in lieu thereof (Effective October 1, 2004):
(a) Any person who steals, confines or conceals any [dog] companion animal, as defined in section 1 of this act, or who, with the intention of stealing such [dog] companion animal or concealing its identity or the identity of its owner or with the intention of concealing the fact that the [dog] companion animal is licensed, removes the collar or harness or tag from any licensed [dog] companion animal, or who unlawfully kills or injures any [dog] companion animal, shall be fined not more than [two hundred] one thousand dollars or imprisoned not more than six months or both. [, and shall also be liable to the owner in a civil action. ] For a second offense, or for an offense involving more than one [dog] companion animal, any such person shall be fined not more than [five hundred] two thousand dollars or imprisoned not less than one year nor more than three years or be both fined and imprisoned.
(b) Any person who violates the provisions of subsection (a) of this section shall be liable to the owner in a civil action, except that, if such person intentionally kills or injures any companion animal, such person shall be liable to the owner in a civil action as provided in section 1 of this act. "

The following is House Amendment Schedule "A" (LCO 4239):
After the last section, add the following and renumber sections and internal references accordingly:
"Sec. 501. Section 7-172 of the general statutes, as amended by section 1 of public act 03-60, is repealed and the following is substituted in lieu thereof (Effective from passage):
No bazaar or raffle may be promoted, operated or conducted in any municipality after the adoption of the provisions of sections 7-170 to 7-186, inclusive, unless it is sponsored and conducted exclusively by (1) an officially recognized organization or association of veterans of any war in which the United States has been engaged, (2) a church or religious organization, (3) a civic or service club, (4) a fraternal or fraternal benefit society, (5) an educational or charitable organization, (6) an officially recognized volunteer fire company, (7) a political party or town committee thereof, [or] (8) a municipality acting through a committee designated to conduct a celebration of the municipality's founding on its hundredth anniversary or any multiple thereof, or (9) any other organization approved for exemption from federal income tax as an exempt organization under Section 501(c) of the Internal Revenue Code. Any such sponsoring organization, except a committee designated pursuant to subdivision (8) of this section, shall have been organized in good faith and actively functioning as a nonprofit organization within the municipality that is to issue the permit for a period of not less than six months prior to its application for a permit under the provisions of said sections. The promotion and operation of a bazaar or raffle shall be confined solely to the qualified members of the sponsoring organization, provided a committee designated pursuant to subdivision (8) of this section may promote or operate through its members and any officially appointed volunteers. No such member or officially appointed volunteer in the case of a raffle held pursuant to subdivision (8) of this section may receive remuneration in any form for time or effort devoted to the promotion or operation of the bazaar or raffle. No person under the age of eighteen years may promote, conduct, operate or work at a bazaar or raffle and no person under the age of sixteen years may sell or promote the sale of any raffle tickets, nor shall any sponsoring organization permit any person under the age of eighteen to so promote, conduct or operate any bazaar or raffle or any person under the age of sixteen to sell or promote the sale of such tickets. Any sponsoring organization having received a permit from any municipality may sell or promote the sale of such raffle tickets in that municipality and in any other town, city or borough which has adopted the provisions of sections 7-170 to 7-186, inclusive. Such organization may accept a credit card, debit card, check or cash as payment for a raffle ticket. All funds derived from any bazaar or raffle shall be used exclusively for the purpose stated in the application of the sponsoring organization as provided in section 7-173. "

GOVERNMENT ADMINISTRATION AND ELECTIONS. H. B. No. 5488 (RAISED) (File No. 111) AN ACT REVISING THE STATE BUILDING CODE FOR SUBSTANTIAL COMPLIANCE WITH THE AMERICANS WITH DISABILITIES ACT.

The following is House Amendment Schedule "A" (LCO 4428):
After the last section, add the following and renumber sections and internal references accordingly:
"Sec. 501. Section 3 of public act 03-231 is repealed and the following is substituted in lieu thereof (Effective from passage):
(a) Each place of public assembly, as defined in the State Fire Safety Code, constructed under a building permit application filed on or after [July 9, 2003,] the effective date of this section or renovated under a building permit application filed on or after said date to increase capacity or change its occupancy, as defined in the State Building Code, that has a single main entrance shall have [a] such main entrance sufficient to allow the emergency exit of two-thirds of the capacity of such place of assembly.
(b) The State Fire Marshal or the State Building Inspector may grant variations or exemptions from, or approve equivalent or alternate compliance with, the requirement in subsection (a) of this section where strict compliance with such requirement would entail practical difficulty or unnecessary hardship, or is otherwise adjudged unwarranted, provided the intent of the provisions of subsection (a) of this section shall be observed and public welfare and safety be assured. Any such determination by the State Fire Marshal or the State Building Inspector shall be in writing. Any person aggrieved by any decision of the State Fire Marshal or the State Building Inspector may appeal to the Codes and Standards Committee within fourteen days after mailing of the decision. Any person aggrieved by any ruling of the Codes and Standards Committee may appeal to the superior court for the judicial district wherein the place of assembly concerned is located. "

The following is House Amendment Schedule "B" (LCO 4029):
Strike lines 8 to 10, inclusive, in their entirety and substitute the following in lieu thereof:
"public highway. On and after October 1, 2004, parking spaces for passenger motor vehicles designated for the handicapped shall be as near as possible to a building entrance or walkway and shall be fifteen feet wide including five feet of cross hatch. On and after October 1, 2004, parking spaces for passenger vans designated for the handicapped shall be as near as possible to a building entrance or walkway and shall be sixteen feet wide including eight feet of cross hatch. Such spaces shall be designated by"
In line 27, strike "such vertical clearance as"
Strike line 28 in its entirety and substitute the following in lieu thereof:
"eight feet two inches vertical clearance at a primary entrance and along the route to at least two parking spaces for passenger vans which conform with the requirements of subsection (h) of this section and which have eight feet two inches vertical clearance unless an exemption has been granted pursuant to the provisions of subsection (b) of section 29-269. "
In line 45, after "safe" insert "and accessible"
Strike lines 169 to 191, inclusive, in their entirety and substitute the following in lieu thereof:
"(c) Such lifts and elevators may be installed (1) in existing buildings principally used for meeting, gathering or assembling by any civic, religious, fraternal or charitable organization, (2) in residential buildings designed to be occupied by one or two families, [and] (3) in new buildings for which a building permit application has been filed on or after October 1, 2004, in accordance with the State Building Code, and [(3)] (4) in other existing buildings and structures only if the executive director of the Office of Protection and Advocacy for Persons with Disabilities and the State Building Inspector jointly approve such installation. An application for the installation of such lift or elevator in other buildings and structures under subdivision [(3)] (4) of this subsection shall be submitted to the State Building Inspector who shall, within seven days of receipt of any such application, forward a copy of such application to said executive director, who shall, within thirty days of receipt, review the application, and acting jointly with the State Building Inspector, render a decision to accept or reject the application in whole or in part.
(d) Any person aggrieved by any such decision of the State Building Inspector and the executive director of the Office of Protection and Advocacy for Persons with Disabilities may appeal to the Codes and Standards Committee within thirty days after such decision has been rendered.
(e) Any person aggrieved by any ruling of the Codes and Standards Committee may appeal therefrom to the Superior Court in accordance with section 4-183. "
